1. Introduction and Acceptance of Terms
Welcome to shop.tyh.org (the "Shop"), an online store owned and operated by Thank You Hashem doing business as "Thank You Hashem" and "TYH" ("TYH," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Shop, including browsing, creating an account, and purchasing products. By accessing or using the Shop, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Shop.
The Shop is built on the Shopify platform. Certain features of the Shop (such as checkout and payment processing) are additionally subject to Shopify's own terms and the terms of our payment processors, in addition to these Terms.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or place an order in the Shop. If you are under 18, you may only use the Shop with the involvement and consent of a parent or legal guardian, who accepts full responsibility for any purchases made.
3. Accounts
You may create an account to check out more quickly and track your orders. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Products and Pricing
We offer apparel, accessories, gift cards, and related merchandise. We make reasonable efforts to display product colors, sizes, and details accurately, but we do not guarantee that your device's display will be accurate. All prices are listed in U.S. dollars unless otherwise indicated and are subject to change without notice. We reserve the right to limit quantities, discontinue products, and refuse or cancel any order, including orders that appear to involve pricing or product-description errors, fraud, or violations of these Terms.
5. Orders and Acceptance
Your placement of an order is an offer to purchase. We may accept or decline your order for any reason, including product availability, errors in pricing or product information, or issues identified by our fraud-detection systems. We will notify you if we decline or cancel an order you have already paid for, and will issue a refund for any amount already charged.
6. Payment
Payment is processed through Shopify Payments and/or other third-party payment processors made available in the Shop. By providing payment information, you represent that you are authorized to use the payment method provided. We do not store your full payment card details; payment information is collected and processed directly by our payment processor(s) in accordance with their own terms and security standards.
7. Sales Tax
Applicable sales tax will be calculated and added to your order total based on your shipping address and applicable law.
8. Shipping and Delivery
We ship to the addresses and destinations made available at checkout. Shipping costs, carriers, and estimated delivery times will be provided at checkout and are estimates only; we are not responsible for delays caused by the shipping carrier or events outside our control. Risk of loss and title to products pass to you upon our delivery to the shipping carrier, except as otherwise required by law. For orders shipped internationally, you are responsible for any customs duties, import taxes, or other fees imposed by the destination country.
9. Returns, Exchanges, and Refunds
All orders are non-returnable and non-exchangeable
Gift cards are non-refundable and cannot be redeemed for cash, except where required by law.
10. Intellectual Property
All content in the Shop — including product designs, photographs, graphics, the "Thank You Hashem" and "TYH" names and marks, and related logos and trademarks — is owned by TYH or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any Shop content without our prior written permission.
11. Prohibited Uses
You agree not to use the Shop to: violate any applicable law; infringe our or any third party's intellectual property or other rights; transmit any virus or harmful code; attempt to gain unauthorized access to the Shop or its systems; engage in any fraudulent activity, including using a stolen payment method; or interfere with the proper functioning of the Shop.
12. Disclaimer of Warranties
THE SHOP AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SHOP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TYH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SHOP OR ANY PRODUCT PURCHASED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless TYH and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Shop, your violation of these Terms, or your violation of any rights of a third party.
15. Termination
We may suspend or terminate your access to the Shop or any account, at any time, for any reason, including violation of these Terms.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new "Last Updated" date, and changes will apply to orders placed after the update. Continued use of the Shop after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of NY, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in NY, and you consent to the personal jurisdiction of those courts.
18. Miscellaneous
If any provision of these Terms is unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and TYH regarding the Shop.
